Arbitrator decides in favour of CUPE 409

June 29, 2015 – Brother Marcel Marsolais, president of CUPE Local 409 reports that after a year and several thousand dollars in costs to our Local and our employer, a decision by arbitrator Irene Holden has found in favour of CUPE 409 in regards to the manner in which the employer attempted to circumvent the collective agreement in 2014.

“The decision is related to the grievance filed by the union on behalf of the several clerical staff positions that were cut in 2014 due to the provincial governments chronic underfunding of K – 12 education that has continuously resulted in budget deficits,” he says.

“The arbitrator ruled in favor of CUPE Local 409’s position and granted the grievance. In other words we won and if we are faced with layoffs in the future the I’m confident that the board will honour the decision and award effected employees the appropriate severance package, bumping rights in accordance with the collective agreement.”
